This Privacy Policy explains how Bizemigrant Sp. z o.o. processes your personal data when you visit the website https://www.bizemigrant.construction, submit a contact form, or otherwise interact with us online. It is prepared in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”, in Polish “RODO”), and with the Polish Electronic Communications Law (Prawo komunikacji elektronicznej, “PKE”) with respect to cookies and similar technologies.

We have written this document in clear, plain language so that you can easily understand who processes your data, why, and what rights you have.

1. Data Controller and contact details

Our business comprises construction contracting (bricklaying, monolithic/reinforced-concrete works, clinker facades) as well as the recruitment of skilled tradespeople in Poland, Belgium, the Netherlands and Germany.

2. Data Protection Officer

The Controller has not appointed a Data Protection Officer (DPO/IOD), as it is not required to do so under Article 37 GDPR. In all matters concerning the processing of your personal data and the exercise of your rights, you may contact us directly at rodo@bizemigrant.construction.

3. How and when we collect your data

We collect personal data:

directly from you — when you complete one of our contact forms, write to us by e-mail, or contact us via messaging apps (WhatsApp, Telegram);
automatically — when you browse the website, through cookies and similar technologies (technical and analytics data).

We operate two types of contact forms:

a) Form for tradespeople / job candidates. We may collect: your name, telephone number and/or messenger contact (WhatsApp, Telegram), trade/specialisation, work experience, country and city, and the status of your documents (e.g. work-authorisation status).

b) Form for developers / B2B clients. We may collect: your name, company name, e-mail address, telephone number, and project details (types of works, area, location).

c) Technical and analytics data collected automatically: IP address, cookie identifiers, marketing tags and parameters (UTM tags, fbclid, gclid), referrer, and the landing (entry) page.

4. Purposes of processing and legal bases

We process your personal data only for specified purposes, each based on a corresponding legal basis under Article 6 GDPR:

Where we rely on legitimate interest (Art. 6(1)(f)), the specific interest is identified in the table above (handling correspondence and enquiries, marketing of our own services, website security, and the protection of legal claims).

5. Categories of personal data we process

Depending on how you interact with us, we may process the following categories of data:

Identification data — name;
Contact data — telephone number, messenger contact (WhatsApp, Telegram), e-mail address, company name;
Form/application data — trade/specialisation, work experience, country and city, document status (candidates); project data such as types of works, area and location (developers/B2B);
Technical data — IP address, cookie and device identifiers, browser information;
Behavioural and marketing data — pages visited, referrer, entry page, UTM tags, fbclid, gclid.

6. Recipients of your data

We disclose your personal data only to the extent necessary and to trusted recipients:

CRM system — applications submitted through the form for tradespeople / job candidates are transferred to our CRM system (portal:), where they are processed for recruitment purposes;
E-mail service — enquiries from developers / B2B clients are received and processed by e-mail;
Meta Platforms Ireland Ltd. — in connection with the operation of the Meta Pixel for advertising and remarketing purposes;
Google (Google Ireland Limited / Google LLC) — in connection with website analytics (Google Analytics / Site Kit);
IT, hosting and supporting service providers — entities that provide us with hosting, IT maintenance and similar services as processors acting on our behalf;
Authorities and public bodies — where disclosure is required by law.

Entities that process data on our behalf do so under data processing agreements and only in accordance with our instructions.

7. Transfer of data outside the European Economic Area (EEA)

In connection with our use of tools provided by Google (Google Analytics / Site Kit) and Meta (Meta Pixel), your personal data may be transferred outside the European Economic Area, including to the United States.

Such transfers take place on the basis of appropriate safeguards required by the GDPR, in particular:

the European Commission’s adequacy decision regarding the EU–US Data Privacy Framework (DPF), where the recipient is certified under that framework; and/or
the Standard Contractual Clauses (SCC) adopted by the European Commission.

8. Retention period

We keep your personal data only for as long as necessary for the purposes described above:

Enquiries and applications submitted through the forms — for the time needed to handle your enquiry or conduct the recruitment process and, where applicable, for the duration of the relationship, plus the period until the relevant claims become time-barred;
Data processed for direct marketing — until you object to such processing or withdraw your consent;
Data processed on the basis of consent (e.g. marketing, analytics and marketing cookies) — until you withdraw your consent;
Accounting and tax records (where a contract is concluded) — for the period required by law, generally 5 years counted from the end of the calendar year in which the tax obligation arose;
Cookies and similar technologies — for the lifetime of each cookie, as specified in Section 11;
Data needed to establish, exercise or defend legal claims — until the relevant claims become time-barred.

9. Your rights

Under the GDPR, you have the following rights in relation to your personal data:

Right of access (Art. 15) — to obtain confirmation of whether we process your data and to receive a copy of it;
Right to rectification (Art. 16) — to have inaccurate or incomplete data corrected or completed;
Right to erasure / “right to be forgotten” (Art. 17) — to have your data deleted in the cases provided for by law;
Right to restriction of processing (Art. 18) — to request that we limit the processing of your data;
Right to data portability (Art. 20) — to receive your data in a structured, commonly used, machine-readable format and to have it transmitted to another controller;
Right to object (Art. 21) — to object, on grounds relating to your particular situation, to processing based on legitimate interest, and to object at any time to processing for direct marketing purposes (including profiling related to such marketing);
Right to withdraw consent — where processing is based on your consent, you may withdraw it at any time, without affecting the lawfulness of processing carried out before the withdrawal. Withdrawing consent is as easy as giving it.

10. Voluntariness of providing data

Providing your personal data is voluntary, but it is necessary to achieve the purpose for which you provide it. In particular:

if you do not provide the data required in the contact form, we will be unable to handle your enquiry, process your application, or prepare an offer;
providing analytics and marketing data through cookies is voluntary and depends entirely on the consent you give via the cookie banner.

Where the conclusion or performance of a contract requires it, providing certain data may also be a statutory or contractual requirement; failure to provide it will then prevent the contract from being concluded or performed.

11. Cookies and similar technologies

Our website uses cookies and similar technologies. Cookies are small text files stored on your device. We use them to ensure the proper functioning of the website, to measure traffic, and for marketing purposes.

In accordance with the Polish Electronic Communications Law (PKE) and the GDPR, cookies other than those strictly necessary are not loaded until you give your consent via the cookie banner. You make your choice actively (opt-in); we do not use pre-ticked boxes, and continuing to browse does not constitute consent.

We use the following categories of cookies:

Managing and withdrawing consent. You can grant, refuse or change your cookie choices at any time using the cookie management panel available on the website (“Manage cookies” / cookie settings) or through your browser settings, which allow you to block or delete cookies. Withdrawing consent is as easy as giving it and does not affect the lawfulness of processing carried out before the withdrawal. Refusing analytics and marketing cookies does not affect access to the content of the website.

12. Profiling and automated decision-making

For marketing purposes, your data — in particular data collected through analytics and marketing cookies (e.g. Meta Pixel, Google) — may be subject to profiling, i.e. automated analysis used to match content and advertisements to your interests and to create audience segments.

This profiling does not produce legal effects concerning you and does not similarly significantly affect you. We do not make decisions that are based solely on automated processing and that produce legal or similarly significant effects within the meaning of Article 22 GDPR.

You have the right to object at any time to the processing of your data for direct marketing purposes, including profiling related to such marketing (Art. 21 GDPR). You can do so by withdrawing your marketing-cookie consent in the cookie management panel or by contacting us at rodo@bizemigrant.construction.

13. Final provisions

We may update this Privacy Policy from time to time, for example to reflect changes in the law, in the technologies we use, or in the way we process data. The current version, together with its effective date, is always available on the website. Material changes will be communicated in an appropriate manner.

This Privacy Policy is effective as of 6 June 2026.
